SB 887B confusion

WE HAVE BECOME AWARE THAT THERE IS STILL SOME CONFUSION AMONG AT LEAST SOME SENATORS OVER THE SCOPE AND APPLICABILITY OF SB 887B. Some are apparently under the impression that the bill applies only to Beaverton.

Some SECTIONS (e.g., Section 1) apply only to Beaverton. Other sections - most notably Section 3 which contains the objectionable "target area only" vote for ORS-195 annexations - apply statewide except as noted in the next paragraph. This came out during the Senate testimony on the bill as well as in our conversations with acting Legislative Counsel.

Under existing state law, Section 3 would not apply in Beaverton: Metro area cities are restricted to using ORS 222 to annex territory (ORS 268.354(3)(a)). That's why Bull Mt. didn't get annexed last year. But Section 3 WOULD apply to the rest of the state. AND WE DON'T WANT THAT TO HAPPEN!

We need to be sure the idea that all sections of the bill apply only to Beaverton does NOT get loose in the Senate! Please note that in your testimony and Senate contacts. If you receive any replies indicating otherwise, respond with a correction. OCVA will issue a memo to the full Senate tonight.
